1. Agreement to These Terms
By accessing or using the Eat! Feel! Shine! mobile application and any related features or services (collectively, the “Service”), you confirm that you have read, understood, and agree to be bound by these Terms of Use (“Terms”).
If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
Changes to the Terms. We may amend, update, or change these Terms from time to time.
When we do, we will update the “Effective Date” above and may provide notice within the App or on a webpage where these Terms are posted. Unless otherwise required by law, the updated Terms will become effective the earlier of:
- (a) 7 days after the updated Terms are posted; or
- (b) the first time you access or use the Service after the updated Terms are posted.
If you do not agree to the revised Terms, you must stop using the Service.
2. Eligibility and Age Requirement
The Service is intended only for individuals who are 18 years of age or older.
By accessing or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
If we learn that you are under 18 (or that you misrepresented your age), we may suspend or terminate your access to the Service.
3. Description of the Service; Service Changes and Availability
Eat! Feel! Shine! is designed to support personal reflection and awareness regarding eating habits and emotions through logging, visualization, and interactive character-based experiences.
Service Changes. The Service may evolve over time.
We may, at any time and in our sole discretion, add, modify, remove, suspend, or discontinue any part of the Service (including features, content, or availability), temporarily or permanently, with or without notice.
Availability. We do not guarantee that the Service will be available at all times or without interruption.
The Service may be unavailable due to maintenance, updates, network issues, or other operational reasons.
4. Registration, Account Security, and Responsibility
Some features of the Service may require you to create or access an account. If you register for an account, you agree to:
- provide accurate, current, and complete information as requested;
- maintain and promptly update your account information so it remains accurate and complete;
- maintain the confidentiality of your login credentials; and
- accept responsibility for all activities that occur under your account.
You agree to notify us promptly if you suspect any unauthorized access to or use of your account. We are not responsible for any loss or damage resulting from your failure to protect your account credentials.
5. Acceptable Use and Prohibited Conduct
You are responsible for your use of the Service and for any use of the Service made using your account. Our goal is to provide a positive, useful, and safe user experience. To support that goal, you agree that you will not, and will not attempt to:
- use the Service in a way that violates any applicable law or regulation;
- harass, abuse, threaten, defame, or harm any person, or encourage illegal or harmful behavior;
- upload or submit content that is unlawful, infringing, defamatory, or otherwise objectionable;
- interfere with or disrupt the Service, servers, or networks connected to the Service;
- access, probe, or test the vulnerability of the Service or any related system, or bypass security measures;
- scrape, crawl, harvest, or collect information from the Service using automated means without our permission;
- reverse engineer, decompile, disassemble, or attempt to derive source code from the App or any part of the Service, except to the extent such restriction is prohibited by law;
- use the Service to create, distribute, or promote malware, spam, or other harmful code or content; or
- use the Service in a manner that could expose the Developer or users to harm, liability, or operational risk.
We reserve the right to investigate violations of this Section and may suspend or terminate access to the Service if we believe you have violated these Terms or if your use creates risk for the Service, the Developer, or others.
6. Nature of the Service; No Professional Advice
The Service is provided for self-reflection and awareness purposes only.
It is not intended to provide medical, psychological, psychiatric, nutritional, or therapeutic advice, diagnosis, or treatment.
You must not rely on the Service as a substitute for professional advice from a licensed physician, mental health professional, dietitian, or other qualified provider. If you have concerns about your physical or mental health, you should seek guidance from a qualified professional.
7. Emotional and Behavioral Effects Disclaimer
The Service allows you to log emotions, thoughts, and reflections related to eating behavior. Such activities may evoke a range of emotional responses, including positive or negative feelings.
You acknowledge and agree that:
- emotional responses and behavioral outcomes vary by individual;
- the Developer does not guarantee emotional improvement, behavioral change, habit formation, or psychological outcomes; and
- any emotional or behavioral effects resulting from your use of the Service are your own responsibility.
8. Character-Based Interaction and Emotional Safety Design
The Service includes fictional characters and visual representations designed solely to enhance engagement and user experience.
The Service is intentionally designed so that user-entered emotions—whether positive, negative, or neutral—do not result in punishment, harm, or deterioration of a character’s state or growth.
Character reactions are intended to be supportive and non-judgmental. They are not designed to induce guilt, shame, pressure, or emotional dependency, and they do not represent real understanding, intent, or judgment.
You agree not to rely on any character interactions for real-world decision-making related to health, emotions, or life choices.
9. Crisis and Emergency Disclaimer
The Service is not designed to provide emergency assistance, crisis intervention, or support for self-harm, eating disorders, or other acute mental health situations.
If you experience severe emotional distress, thoughts of self-harm, or believe you may be at risk, you should seek immediate assistance from emergency services or qualified professionals in your area.
10. User Content and Limited License
You are solely responsible for all content you enter, submit, or store through the Service, including text, emotional logs, reflections, and other inputs (“User Content”).
You retain ownership of your User Content. By using the Service, you grant the Developer a limited, non-exclusive, non-transferable license to store, process, and display your User Content solely for the purpose of operating and providing the Service’s functionality.
The Developer does not review, verify, or guarantee the accuracy, completeness, or appropriateness of User Content and is not responsible for any consequences arising from it.
11. Intellectual Property
All content and materials provided through the Service, including software, design, characters, visuals, animations, text, and logos (collectively, “Service Content”), are owned by or licensed to the Developer and are protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any Service Content.
You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose.
12. Account Termination and Data Deletion
You may stop using the Service or delete your account at any time through the available in-app functionality.
The Developer reserves the right to suspend or terminate your access to the Service at any time if you violate these Terms or if your use creates legal, security, or operational risk.
Account deletion may result in the permanent and irreversible loss of User Content and data. You acknowledge that the Developer is not responsible for any consequences resulting from such deletion.
13. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
To the maximum extent permitted by law, the Developer disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.
The Developer does not warrant that the Service will be uninterrupted, error-free, secure, or free from defects.
14. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, consequential, special, or emotional damages arising out of or related to your use of, or inability to use, the Service.
If liability cannot be excluded under applicable law, the Developer’s total liability shall be limited to the amount paid by you for the Service, if any, during the twelve (12) months preceding the event giving rise to the claim.
15. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
16. Third-Party Services and Links
The Service may integrate with or rely on third-party services, platforms, or software (such as authentication providers, analytics services, cloud infrastructure, or app distribution platforms).
Your use of such third-party services is subject to their respective terms, conditions, and privacy policies. The Developer does not control and is not responsible for the content, availability, accuracy, or practices of any third-party services.
The Developer shall not be liable for any damage or loss arising from your use of, or reliance on, third-party services or links.
17. Apple App Store Terms
If you access the Service through an application obtained from the Apple App Store:
- These Terms are an agreement between you and the Developer, not Apple. Apple is not responsible for the Service or its content.
- Your use of the App must comply with Apple’s App Store Terms of Service.
- Apple has no obligation to provide maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, in accordance with its policies. To the maximum extent permitted by law, Apple will have no other warranty obligations.
- Apple is not responsible for addressing any claims relating to the App, including but not limited to product liability claims, claims that the App does not comply with legal or regulatory requirements, or claims arising under consumer protection laws.
- In the event of any third-party claim that the App infringes intellectual property rights, the Developer—not Apple—will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
- You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that Apple has the right to enforce these Terms against you as a third-party beneficiary.
18. Indemnification
You agree to defend, indemnify, and hold harmless the Developer from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- your use of or access to the Service;
- your User Content;
- your violation of these Terms; or
- your violation of any applicable law or the rights of any third party.
19. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict-of-law principles.
You agree that any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, unless otherwise required by applicable law.
20. Entire Agreement
These Terms, together with any policies or notices referenced herein (including the Privacy Policy), constitute the entire agreement between you and the Developer regarding the Service and supersede all prior or contemporaneous agreements, communications, or understandings.
21. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
The failure of the Developer to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
22. Language
These Terms are written in English.
If these Terms are translated into another language and there is any conflict between the English version and a translated version, the English version shall prevail.
